THIS LICENCE AGREEMENT controls your right to use any image(s) downloaded from David Chew Photography for general purposes.You agree to be bound by the terms hereof by downloading any image(s). IN CONSIDERATION of the payment of the fees stated for downloading one or more photographic images from the David Chew Photography web site (www.davidchewphotography.com), and in further consideration of your acceptance of the provisions of this agreement, David Chew Photography hereby grants you a personal, non-transferable, non-exclusive right to use such images subject to the following terms and conditions: Use: You are licenced to use the image(s) worldwide for any of the following: (A) Marketing Communications (B) Advertising and Promotions (C) Corporate Communications (D) Editorial Use (E) Online, Web and Multimedia Applications (F) Environmental Graphics Improper use: Under no circumstances shall the images(s) be used for pornographic, libellous, defamatory or any other improper or illegal purposes. Extended Use. Additional rights to use the image(s) on products for sale are available. For such extended use, please contact David Chew Photography at dcpmy@streamyx.com Ownership. All rights to the image(s) are owned by David Chew Photography and its licensors and are protected by the Malaysia copyright laws, international treaties and other applicable laws. David Chew Photography and its licensors retain any and all rights, titles and interests not expressly granted by this licence agreement. You may not distribute, transfer, assign or sub-licence the image(s) without the prior written consent of David Chew Photography. Model and Property Release. All Photographs do not have model or property releases unless otherwise stated. Watermark. All David Chew Photography images are digitally watermarked at the point of purchase. In the event of a copyright dispute or improper use, these watermarks will be used as evidence in a court of law. Warranties: David Chew Photography warrants that the download digital image(s) are free from defects in material and workmanship for seven (7) days from the time downloading and delivery. Your sole and exclusive remedy for a breach of this warranty is the replacement of the image(s) or refund of the purchase price at the sole discretion of David Chew Photography. Damages. David Chew Photography shall not be liable for any general, special, direct, indirect, incidental or consequential damages arising out of the licence and use of the image(s). Notices. Any notices or requests to David Chew Photography may be addressed to the company by e-mail at dcpmy@streamyx.com or in writing to Manager, David Chew Photography, 24, Cangkat Sungai Ara 3, Desa Ara, Bayan Lepas 11900, Penang Tel: 019-4476297 Termination. This agreement shall terminate upon violation of any of its provisions. Upon termination you must immediately stop using the image(s), delete all copies of such image(s) from your computer and all magnetic media. Governing Law. This agreement shall not be controlled by Malaysian law and venue for any disputes arising hereunder shall be brought in the courts in Malaysia. NOTE: YOUR DOWNLOADING OF ANY IMAGE(S) CONSTITUTES YOUR CONSENT TO AND ACCEPTANCE OF THE FOREGOING IMAGE LICENCE. |
